Feline Felons Cat Cafe Terms and Conditions

Welcome to Feline Felons Cat Cafe ("the Cafe"). Before you participate in any activities at the Cafe, please carefully read and understand the following terms and conditions. Your participation in any activities at the Cafe constitutes your agreement to comply with these terms and conditions:

1. Age Requirement:

Participants must be either:
(a) At least 18 years of age, or
(b) Younger than 18 years of age but accompanied or supervised by a parent or guardian who provides explicit written consent for the minor's participation in the activity. Explicit written consent includes a signed and dated document in which the parent or guardian acknowledges and agrees to the terms outlined in these terms and conditions, affirming that they understand these terms will be legally binding on both the minor and themselves.

2. Assumption of Risks:

Participants acknowledge and understand that activities at the Cafe inherently involve risks and dangers, including but not limited to the risk of infection, disease, personal injury, and property damage. Participants voluntarily choose to participate in these activities with full knowledge and understanding of these inherent risks. If participants have any questions or concerns about these risks, they should seek clarification from Cafe staff before participating.

3. Release and Waiver of Liability:

Participants release and forever discharge the Cafe, The Charles County Animal Care Center, The Humane Society of Charles County, The Queen Anne's County Animal Services, and their agents, employees, members, directors, managers, officers, servants, volunteers, subsidiaries, successors, and licensors (collectively, "Releasees") from any and all liability, claims, demands, actions, causes of action, costs, or expenses of any kind or nature, including attorney's fees and expenses, arising from or related to any harm, loss, damage, or injury, including bodily injury, suffering, death, or property loss resulting from or in connection with the activities at the Cafe. This release includes any claims resulting from the negligence of the Releasees.

4. Indemnification:

Participants agree to indemnify and hold each of the Releasees harmless from any claims, losses, actions, or proceedings initiated against any Releasee by any person or entity in relation to the participant's activities at the Cafe. This means that participants will be responsible for covering any legal or financial obligations incurred by the Releasees due to the participant's actions or participation in the activities.

5. Compliance with Rules and Photography:

Participants agree to abide by all rules and regulations ("the Rules") imposed by the Cafe in connection with participation in activities. Participants acknowledge that Cafe staff will be present but may not supervise individual activities. Participants shall not engage in any activity that may harm the cats in any manner. Flash photography is strictly prohibited, as it can distress the cats. Participants also consent to being recorded by surveillance cameras for security purposes. Violation of these rules may result in immediate expulsion from the Cafe without a refund.

6. Continuation of Obligations:

These terms and conditions shall remain in effect both during and after participation in the activities at the Cafe. This means that participants are still bound by these terms even after they have left the Cafe.

7. Health and Fitness Responsibility:

Participants are solely responsible for assessing their own mental and physical capability to safely participate in the activities. Participants represent and warrant that they are physically and mentally fit for participation and do not have any condition or allergy that would prevent safe participation. If participants have any doubts about their health or fitness, it is recommended that they consult with a medical professional before participating.

8. Applicable Law:

These terms and conditions will be construed under Maryland law. Any disputes arising under or in connection with these terms and conditions shall be resolved through binding arbitration in accordance with the rules and procedures of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. This section outlines the process for resolving legal disputes that may arise from these terms and conditions.

By participating in any activities at Feline Felons Cat Cafe, you acknowledge that you have read and understood these terms and conditions. Your participation signifies your agreement to comply with all provisions outlined herein. Failure to adhere to these terms and conditions may result in termination of participation without a refund. Please be aware of and adhere to these terms and conditions during your visit to Feline Felons Cat Cafe.
